General Terms and Conditions for the Online Shop June
These General Terms and Conditions govern the use of our online shop June and the related legal aspects between you as the customer and us as the operator.
1. Scope
a) Contracting party: The contracting party for orders placed via our online shop June is Pölking UG, Schönensche Straße 1, 10439 Berlin, Germany, represented by Janina Pölking (hereinafter "we" or "us").
b) Applicability: These Terms and Conditions apply to all orders placed via our online shop.
2. Conclusion of Contract
a) Offer and acceptance: By placing an order in our online shop, you submit a binding offer to purchase the selected items. The contract is concluded when we accept your order by sending an order confirmation by email.
b) Availability: All offers in our online shop are subject to change and non-binding. If an ordered item is not available, we reserve the right not to accept the order or to offer you a replacement product.
3. Prices and Payment Terms
a) Prices: All prices in our online shop are stated in euros and include statutory VAT.
b) Payment: Payment can be made by prepayment, credit card, PayPal or other payment methods offered during checkout. We reserve the right to exclude certain payment methods.
4. Delivery and Shipping
a) Delivery area: We deliver within Germany and to selected countries of the European Union.
b) Shipping costs: Shipping costs are displayed during checkout and are borne by the customer, unless expressly agreed otherwise.
c) Delivery times: Delivery times are stated on the respective product page. They are non-binding, unless a binding delivery date has been expressly agreed.
5. Right of Withdrawal
a) Withdrawal notice: You have the right to withdraw from your contract within 30 days without giving any reason, either in text form (e.g. letter, email) or by returning the goods.
b) Return costs: The costs of returning the goods are borne by the customer.
6. Retention of Title
The goods delivered remain our property until paid in full.
7. Warranty and Liability
a) Warranty: The statutory warranty provisions apply.
b) Liability: We are liable for damages in accordance with statutory provisions insofar as they are based on intent or gross negligence.
8. Data Protection
We process your personal data only within the scope of the statutory provisions. Further information can be found in our Privacy Policy.
9. Final Provisions
a) Applicable law: The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
b) Place of jurisdiction: The place of jurisdiction for all disputes arising from this contract is Berlin, provided you are a merchant, a legal entity under public law or a special fund under public law.
c) Severability clause: Should individual provisions of these Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
